Terms & Conditions

1. Our Contract.

1.1 These Terms and Conditions govern the supply of goods sold by Aquarium Online of Unit 3 Bishops Road Industrial Estate, Lincoln, LN2 4JZ (we and us) to the customer (you). Our VAT number is 882 8374 78

1.2 All orders placed by you and purchases of goods from us (whether in-store, by telephone, via our website or by such other means as we may permit) are on the basis of these Terms and Conditions and are subject to acceptance by us either (as applicable): (i) by delivery of the goods to you; or (ii) by providing the goods you have purchased to you at the trade counter, at which point a legally binding contract is constituted between us.

1.3 The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

2. Ordering

2.1 On our website, you may place an order to purchase a product advertised for sale by following the onscreen prompts after clicking on the item you wish to purchase. You will have an opportunity to check and correct any input errors in your order up until the point at which you place your order by clicking the "Place order and pay" button on the checkout page.

2.2 All orders placed by you and purchases of goods by you from us are subject to acceptance by us (as described in clause 1.2). We may choose not to accept your order or purchase for any reason and will not be liable to you or to anyone else in those circumstances.

2.3. Shipping costs are shown in the shopping cart but where additional shipping costs are incurred due to location (such as Highlands and Islands) we will use reasonable endeavours to contact you and ask you whether you wish to continue with the order with the extra shipping surcharge. If we are unable to contact you or you do not wish to continue with the order with the additional shipping cost, we will cancel your order and refund the price you have paid.

3. Price & Payment

3.1 The price payable for the goods you order or purchase is as set out in store and on our website at the time you submit your order plus any charges for delivery as advised to you. All prices include the current applicable VAT rate.

3.2 Occasionally, an error may occur and goods may be either incorrectly priced or described in which case we will not be obliged to supply the goods at the incorrect price or in accordance with the incorrect description or at all. We reserve the right to correct any errors from time to time. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order at the correct price or correct description. If we are unable to contact you or you do not wish to continue with the order at the correct price or correct description, we will cancel your order and refund the price you have paid.

3.3 For website orders, payment can be made by most major credit or debit cards, by completing the relevant details on the checkout page.

3.4 By using a credit/debit card to pay for your order or purchase, you confirm that the card being used is yours or that you are authorised to use it. By using PayPal you confirm that the PayPal account being used is yours.

3.5 All credit/debit card holders are subject to validation checks and authorisation by the card issuer. All PayPal payments are subject to authorisation by PayPal. If the issuer of the card or PayPal refuses to authorise payment we will not accept your order or purchase, we will not be obliged to inform you of the reason for the refusal, and we will not be liable for the item not being delivered or provided to you. We are not responsible for the card issuer or bank charging the holder of the card as a result of our processing of your credit/debit card payment in accordance with your order or purchase or if PayPal charges you for making the order.

4. Cancellation Policy

4.1 You have the right to cancel an order within 7 working days of receipt. You must return the goods to us in new and unused condition in line with our Returns Policy. We must receive the goods within 21 days of the notice of cancellation during which time you are responsible for any loss or damage. Once received in new and unused condition we will refund the purchase price less the original carriage charges.

5. Replacement Policy

5.1 If faulty goods are received you must notify us within 7 working days. Where possible replacement parts will be dispatched and where not possible we will ask you to return the goods to us in line with our Returns Policy. Once we have verified the damage we will supply replacements as required. Where goods returned to us are in good working order we are not able to refund your return postage costs and we reserve the right to deduct our original postage cost and a restocking fee from any refund.

6. Manufacturers Guarantees

6.1 We work with the manufactures to ensure their guarantees are honoured and we use our best endeavours to resolve issues within the warranty period. We can only refund postage costs under the manufactures guarantee if the goods are returned to us within 7 days of the original purchase. We can only offer replacements parts or replacement goods when authorized by the manufacture. Under no circumstances should goods be returned to us without prior approval. We can only replace glass bulbs, tubes and lights if notified within 7 days of delivery.

7. Electrical Equipment

7.1 Please be aware that aquarium pumps, filters, skimmers and other electrical goods emit noise during normal operation that you may consider to be excessive. You should be aware that manufacturers wording indicating noise levels are relative only and do not necessarily give indications of measured decibel levels. Return of good under these circumstances requires the agreement of the manufacturer and where goods returned are deemed to be in good working order by the manufacturer we are unable to offer a refund and may charge return postage.

8. Returns Policy

8.1 Goods have to be returned to us at your expense. It is important that you obtain proof of posting as the goods are your responsibility until they are received by us. We can only refund postage costs if goods are returned within 7 days of purchase under the Replacement Policy. You should use the cheapest postage method available as we are not able to refund the cost of any special delivery service. We cannot refund postage for goods returned for any other reason and we reserve the right to deduct our original postage cost and a restocking fee from any refund applicable.

8.2 The total price payable for the goods will be stipulated at the time when you place your order.

8.3 We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong. We will inform you of the correct price and give you the opportunity to cancel the order.

8.4 Until dispatch of goods by the seller of goods to the buyer or the buyer's acceptance in writing of any quotation of the seller (whichever shall first occur) no contract for the sale of goods shall arise.

8.5 All prices on our website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order.
